Planning Developments to Property

As with any property purchase, those buying a house on the Estate will sign a contract in which the deeds will have incorporated the Covenants dating from the property’s original construction. These covenants are effectively binding between the purchaser and all other shareholders of the Company they have chosen to join. They state that any development of a property which can impact on its appearance and, thereby, on the character and appearance of the area, must have the approval of the Aldwick Bay Company Ltd, representing all of its Shareholders.

Notwithstanding the above, any development whether it be adding an extension or changing the construction of a boundary will usually require planning permission from Arun District Council. However, before applying, owners are requested to submit their plans to the Company Planning Director who will not only talk them through the process, but importantly offer advice before bringing the plans to the Board for scrutiny. Solicitors acting for potential buyers are scrupulous in demanding to see proof, before completion, that all the necessary planning and other approvals have been gained. As part of this process the Company will be required to attest that there have been no breaches of covenants in relation to the property and therefore it is important that anyone contemplating any development of their property follows the guidance set out above.

Following on from the initial discussion, the Planning Director may attend either or both of the Parish and Arun District Council Planning Meetings, especially if there have been any objections or the application is controversial. In either case he or she is always asked to say whether or not the Company objects to the application. Clearly it is in the shareholder’s own best interests that discussion of any proposals takes place at the earliest date.

Employment of Contractors

Guidelines for Work on the Estate

All Shareholders/residents who wish to carry out work on the Estate, or to employ contractors to undertake work on their behalf, are encouraged to read these guidelines carefully.

Rubbish skips, building materials or spoil
Most roads, footpaths and verges on the Estate belong to Aldwick Bay Company Ltd. During any period of work, whenever possible building materials, spoil or rubbish skips are to be positioned on site where the former is safer and far less of a traffic hazard. On no account may they be deposited/positioned on Company Property without prior written permission from the Company which must be obtained in advance by applying via email or letter marked “for the attention of the Planning Director”. If consent is given, the items listed above are to be: –
a. placed on a board to protect the underlying surface,
b. lit at night, and
c. properly cordoned with reflective tape or fenced off.

Damage to Company Property
On completion of any project the Company property must be left in at least as good a condition as before the work began. Any damage to roads, paths, crossovers, verges, signage, trees, shrubs or lamp standards must be made good. Residents are responsible for arranging and paying for any necessary restorative work even where permission has been given in advance to place material or machinery on Company property.

If the former is not carried out within a reasonable period, the Company will arrange for the work to be done and recover the cost from the resident. To save unnecessary expense, residents should ensure contractors do not cut across the verge when entering their property as this can cause significant and lasting damage. They should also take care to ensure no materials or spoil are washed down Estate road drains or soakaways, as this blocks them very quickly, is costly to remove and could lead to flooding in the future.

Delivery and Contractors Vehicles
To avoid excessive wear to the Estate roads and prevent damage to any utility’s infrastructure, contractors and their subcontractors should not use vehicles exceeding a maximum gross vehicle tonnage of 26 tonnes. This may mean multiple deliveries or collections of equipment or material to ensure the loaded vehicle weight does not exceed the limit. ALL vehicles must observe the 20mph speed limit and park with the nearside wheels on the road.

Hours of Work and Noise Generation
In the interest of good relations with neighbours, residents must advise any contractor to restrict noisy operations to between 8.00 am and 5.30 pm Monday to Friday, avoid such work on Saturday and not after 1pm, and never allow such work on a Sunday or Public Holidays. Contractors must not play music that can be heard by neighbours.

Boarding
Contractors’ advertising boards should be removed within 7 days of the completion of the work.

Gate entrances

The Estate has two main entrances – one at A’Beckett’s end of the Estate on Nyetimber Lane. This has electric gates which are activated by a Zapper or a telephone number.

The Gate Zappers cost £37 each, which is the amount the Company pays for them. Alternatively, you can log your telephone number and this will activate the gates.

Southern Water SEWER PIPE LINING Project Update

Please take a look at the document below outlining Southern Water’s plans to address the sewer pipe bursts we have experienced along Manor Way.

The work was planned for May 2026 and expected to take 15 days.   However, this has now been pushed back by Southern Water to late September 2026.  “It’s been too dry”.
